I am receiving second-hand surplus asset(s) (the “Asset”) from Indeed.  Surplus assets are Indeed-owned items located within Indeed offices. I understand that it is my responsibility to pick up the Asset, and if I am unable to pick up the Asset within the requisite time frame, it will be relisted.  I understand that the Asset is not being received as a new product, but provided in an ‘as-is’ condition and without any warranty of any kind from Indeed.

I have read and acknowledge the below disclaimer of Indeed liability:

NO REPAIR, REPLACEMENT OR MAINTENANCE IS IMPLIED OR OFFERED. BY MY RECIEPT OF THE ASSET, I ASSUME ALL RISK, RESPONSIBILITY AND LIABILITY THAT MAY ARISE IN CONNECTION WITH MY RECIEPT AND USE OF THE ASSET, INCLUDING ANY INJURY OR PROPERTY DAMAGE TO MYSELF OR OTHERS WHILE PICKING UP THE ASSET  .  TO THE EXTENT LEGALLY PERMITTED, I RELEASE AND DISCHARGE INDEED AND ITS EMPLOYEES, AGENTS AND/OR CONTRACTORS FROM AND AGAINST ALL CLAIMS OR LIABILITY FOR ANY INJURY OR DAMAGE (INCLUDING BUT NOT LIMITED TO BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH OR PROPERTY DAMAGE) ARISING OUT OF OR ATTRIBUTABLE TO MY RECIEPT AND USE OF THE ASSET.

I AGREE TO INDEMNIFY AND HOLD HARMLESS INDEED AND ITS EMPLOYEES, AGENTS AND/OR CONTRACTORS FROM ALL LOSS, COSTS, EXPENSES, DAMAGE, CLAIMS OR LIABILITY (INCLUDING ATTORNEYS’ FEES, AND THE FEES AND COSTS OF ENFORCING ANY RIGHT TO INDEMNIFICATION) ARISING OUT OF OR RESULTING FROM MY RECIEPT AND USE OF THE ASSET, INCLUDING CLAIMS OR LIABILITY RELATING TO INJURY TO OTHERS, TO THE EXTENT LEGALLY PERMITTED  .

I agree that electronic signature of this Form shall have the same binding effect as a handwritten signature.  Photographic and facsimiled copies of this Form shall have the same force and effect as an original and shall constitute an effective, binding agreement on my part.

I HAVE READ THIS SURPLUS ASSET RELEASE AND WAIVER OF LIABILITY FORM AND FULLY UNDERSTAND ITS TERMS.  I agree that if any portion of this Form is held to be invalid, the balance notwithstanding, shall continue in full legal force and effect.  This Form, and the rights, obligations and liabilities set forth herein shall be construed in accordance with the laws of the state (if in the U.S.) or country (if outside the U.S.) where Indeed physically holds the Asset on the date of signature of this Form, without regard to the conflict of law principals of such state or country.  The undersigned agrees that any action with respect to this Form shall be brought in a court of competent subject matter jurisdiction located in such state or country.

How does the Employee Gifting Program work?	Employees will be given the opportunity to request items from this online portal from [dates]. After requests are submitted, you will be notified of the items allocated toward your pick-up. You will receive an email to select a pick-up time, along with a Transfer of Title (TOT) document that must be e-signed prior to your pick-up.
Can I request items that were at my personal workstation?	Items will be pulled into our staging area, thus making it difficult to allocate a specific item for a specific user.
Can I place items on hold?	No, you cannot place items on hold.
What happens if multiple people request a specific item?	Items will be put into a lottery and randomly assigned to one request.
My item is broken - what do I do?	If you notice that your item is faulty while at your pick-up, this can be reviewed at the time.

Where do I book a pick-up time?	After the program has closed, you will receive a confirmation email with your order number, a reminder of the pick-up location, and a link to select a pick-up time.
What happens if I can’t make my pickup time?	Please refer to your pick-up confirmation email to switch your pick-up time. If you do not collect your item(s) within the allocated timeframe, they will be placed for donation with a local non-profit.
Where can I pick-up my items?	Pick-up will be at [warehouse address], between [dates]. You must schedule a pick-up time and arrive during your pre-organized time slot.
Can items be delivered to me?	There is no option for home delivery. Please arrive to the pick-up prepared with transportation that can accommodate your selection, and ensure you have assistance with you if that will be needed for loading.
Will someone load my items into my car?	No, please ensure that you have the assistance you need for loading your vehicle. Our move team will only be able to bring items to the loading zone. Employees will be responsible for loading their own vehicles.
